1. Acceptance of Terms

By accessing or using HushWork ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.

2. Description of Service

HushWork is a browser-based focus environment that provides ambient soundscapes, a focus timer, distraction-free note-taking, and related productivity features. The Service is available in both a free tier and a paid subscription ("Pro") tier with additional features.

3. Accounts

You may use HushWork without creating an account. Certain features (including Pro subscription and cloud sync) require authentication via a magic link sent to your email address. You are responsible for maintaining the security of your email account and any activity that occurs through your HushWork account.

4. Pro Subscription

Pro subscriptions are billed on a monthly or annual basis through Stripe. Payments are non-refundable except as required by applicable law. You may cancel your subscription at any time through the Stripe Customer Portal accessible from the Settings panel. Cancellation takes effect at the end of the current billing period.

5. User Content

Notes, focus sessions, and other content you create through the Service remain your property. For free-tier users, data is stored locally in your browser. For Pro users who enable cloud sync, notes are stored on our servers. You may delete your data at any time.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to interfere with or disrupt the Service
• Reverse-engineer, decompile, or disassemble any part of the Service
• Resell or redistribute access to the Service without permission
• Upload malicious content through background image uploads or notes

7. Intellectual Property

The Service, including its design, code, soundscapes, and branding, is owned by HushWork. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal and professional productivity purposes.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not liable for any data loss, including locally stored notes or focus session history.

9. Limitation of Liability

To the fullest extent permitted by law, HushWork shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid for Pro subscription in the 12 months preceding the claim.

10. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
